The Cattle Ownership Members’ Association has approached the High Court to recover $8 million from the Cattle Ownership Society Trust following a botched cattle deal.

Cattle Ownership Members’ Association chairman Patson Chivaura, who is representing other members, has asked the High Court to allow Marvellous Shumba, whom he claimed is the founding trustee of Cattle Ownership Society Trust, to be the second respondent.

“It is therefore my prayer that Shumba be joined as a second respondent and be joined to the proceedings in case No. HC 7098/19 so that he can be given the opportunity to provide the court his side of the story,” he said.

“In terms of the defendant’s deed of trust, members of the cattle ownership scheme registered and made contributions to the defendant for an agreed amount of time after which they would be entitled to cattle commensurate with each person’s contributions.

“After making the required contributions to the defendant, the association members made claims against the defendant for the allocation of cattle in terms of the Trust’s Deed, but the defendant failed, neglected and or refused to pay in terms of the promises made.”

Despite the fact that their contributions were paid and acknowledged to be received, Chivaura argues, Cattle Ownership Society has failed to honour its agreement.

“We pray for an order compelling the defendant to pay of the sum of $8 000 710 and interest from the due date at the rate of 5 percent to the date of final payment. Costs of suit on a client and attorney scale,” he said.
