Unlicensed driver jailed, banned

An unlicensed city kombi driver was on Wednesday jailed for 18 months and banned from driving for life after he was convicted of negligent driving and driving without a licence by a Mbare magistrate.

Lucky Mutava (40) of number 3854 Budiriro 2 appeared before magistrate Ms Anita Tshuma.

Ms Tshuma sentenced Mutava to 24 months in prison before suspending six months of the sentence for five years on condition that he does not commit a similar offence during that period.

In passing sentence, Ms Tshuma considered that Mutava was a first offender who had shown contrition by pleading guilty to the offence.

“You committed a very serious offence. Such offences are now prevalent and a deterrent sentence is appropriate,” she said. Facts are that on July 4 Mutava who is not a holder of a driver’s licence, was driving a public service vehicle with 18 passengers along Willowvale Road in Harare. As he was driving he hit a pedestrian, Tawanda Makoni, who was walking along the road. After hitting Makoni, Mutava stopped and took the injured pedestrian to the police before proceeding to the hospital. Makoni was admitted at Harare Central Hospital for treatment and was released the following day.
