Zimbabwe Entrepreneurs Youth Action (Zeya) president James Pande has had his property attached over non-payment of rental arrears and related charges amounting to nearly US$10 000. James, of the Hovhorosi style fame, owed Mutual Finance Private Limited US$6 000 in rentals for flat number 17 at Bramley Gardens in Avondale.
Harare Civil Court magistrate Ms Vongai Muchuchuti gave a default judgment after James failed to appear in court and ordered him to pay US$9 993 inclusive of holding over damages and cost of lawsuit.
According to papers filed under case number 15709/13, property attached by the Messenger of Court includes a three-piece lounge suite, a wooden table, a Philips television set, a single door refrigerator, two wooden chests of drawers and a 13-piece black wooden stand and glasses.
The property also includes a Telefunken television set, a Defy Microwave, a deep freezer, a glass table, five stools, seven chairs, a Defy double-door fridge and a five-piece reed sofa set.
However James’ brother, Joseph, today filed an appeal asking the court to rescind the ruling saying the property attached belonged to him.
“The property belongs to me and I placed them at my older brother’s residence because I had been evicted from where I was staying. The proof was destroyed during eviction since there was no one present and also it was raining,” he said.
Mutual Finance, represented by Mr Ryan Stewart of Wintertons Legal Practitioners, argued that Joseph did not indicate what his relationship to James was.
“The attached property was to settle rental arrears accrued by James and it is not clear on how he says the property belongs to him,” he said.
Harare Magistrate Mr Brighton Pabwe deferred the matter to January 16 for ruling.
