CCC members seek to block police officer

TWENTY-SIX CCC members charged with illegally gathering at their Member of Parliament’s house in Budiriro with intent to cause public violence today moved to block one of the police officers from testifying on how they apprehended them during their bail application.

The State wants the police officer to chronicle how they apprehended the CCC members at Costa Machingauta’s house in Harare last week.

Through their lawyers, the 26 claimed that the investigating officer handling the matter has already laid enough grounds in opposing bail and there was no need to call another witness.

They also claimed that the evidence already placed before the court was enough for Harare magistrate Mrs Yeukai Dzuda to arrive at a decision regarding bail.

The 26 also told the court that they do not know the witness, who could have been in court and heard all the court proceedings.

In its response, the State argued that there was no law which bars it from calling the police officer and that there was no law which also prescribes on how bail hearings should be conducted.

Mrs Dzuda adjourned the court to allow her to prepare the ruling.
