A 37-year-old Harare man who overpowered his attacker six years ago and allegedly fatally struck him with an iron he wrestled from him appeared in court yesterday.

Martin Nohumba (37) appeared before Harare magistrate Mr Hoseah Mujaya facing culpable homicide charges.

Nohumba is charged with causing the death of Soamus Zvipindu by negligently failing to realise that death would result from is conduct and failed to guard against that possibility.

Nohumba was not formally charged and was remanded out of custody to December 11.

Prosecutor Mr Ephraim Zinyandu alleged that on February 19 2008 around 5am, Nohumba disembarked from a commuter omnibus at corner Harare Drive and Kirkman Road in Mabelreign.

He proceeded to his workplace in Bluffhill, where Zvipindu attacked him with an iron bar. Nohumba overpowered him and took the iron bar from him before striking him on the head.

The court heard that Zvipindu fell down and Nohumba proceeded to his workplace leaving him for dead.

He later reported the matter at ZRP Mabelreign and police attended the scene and Zvipindu was pronounced dead on arrival at Parirenyatwa Hospital.

A post mortem carried out revealed that Zvipindu succumbed to skull fractures due to the assault.
