A WHAWHA inmate serving a nine -year prison term for rape had his jail term extended by two more years on Wednesday after he was convicted of indecently assaulting a fellow inmate. Kudakwashe Mudzetse (25) of Simchembo Village, Gokwe South, appeared before Midlands provincial magistrate Mrs Phathekile Msipa facing one count of indecent assault.

Mudzetse was convicted despite pleading not guilty. “You denied the charge during cross examination and you did not oppose everything which was said by the State witnesses,” said Mrs Msipa. “You are, therefore, found guilty and you are sentenced to two years in prison.”

The court heard that Mudzetse was in 2013 sentenced to nine years in prison for rape. The agreed facts were that on November 11 at around 11pm at Whawha Prison, Mudzetse and the complainant (name withheld) were sleeping in the same cell, but in separate places. Each had his own blanket. The complaint, who had just been remanded in custody on a murder charge, was naked since he only had one prison garb, which he was supposed to put on the following morning.

The court heard that Mudzetse got up from where he was sleeping and indecently assaulted the complainant who was asleep. Mudzetse woke up and discovered that he was being sodomised and woke up a fellow cellmate so that he could be a witness to the indecent assault.
