Court clears lawyer of property fraud

A prominent Masvingo lawyer, Joseph Maweni, who was facing fraud charges involving the transfer of a property has been acquitted.

Maweni was accused of drafting a fake agreement of sale, which he used to mislead the High Court into transferring a property.

He was jointly charged with a haulage truck driver, Sam Momberume.

Masvingo magistrate Ms Florence Nago acquitted Maweni and Momberume for lack of incriminating evidence.

She referred the matter to the Civil Court where an examiner should be called to determine the authenticity of the disputed agreement of sale.

This was after Maweni and Momberume pleaded with the court to call a documents examiner to determine the authenticity of the agreement of sale.

The pair were being accused of conniving and drafting a fake agreement of sale, which they presented to the High Court in Harare seeking the transfer of a residential stand in Masvingo’s Runyararo West suburb.

Maweni and Momberume were accused of using a fake agreement of sale that the High Court used to order a Masvingo City Council housing director to transfer the residential stand into Momberume’s name.

The matter was reported to police after another person claimed to have bought the same residential stand and also produced an agreement of sale for the same property.

Ms Chiedza Muhwandavaka prosecuted.
