Sikhala, Sithole applications dismissed Job Sikhala

HARARE magistrate Mr Stanford Mambanje yesterday threw out CCC lawmakers Job Sikhala and Godfrey Sithole’s bid to challenge their placement on remand saying they were properly placed before the court.

Mr Mambanje, in his ruling, said there was no need to prove that they had committed the alleged offence, but the State needed to show reasonable suspicion that the two committed an offence. Sikhala and Sithole are charged with incitement to commit public violence after they allegedly called people to cause violence in revenge for the death of Moreblessing Ali in Nyatsime area. They are accused of posting a video allegedly inciting violence to avenge the death of Ali while Sithole stands accused of providing his vehicles to ferry their party’s members from Epworth and Chitungwiza to Nyatsime.

After being denied bail, the duo, through their lawyers Ms Beatrice Mtetwa and Mr Jeremiah Bamu, were quick to apply for bail on changed circumstances.

They told the court that there is no evidence that proved that he recorded and posted the alleged video with alleged inflammatory statements. Sithole also disputed the link between him and the alleged hiring of the vehicles saying the State had not shown any evidence to that effect. In dismissing their application for bail in changed circumstances, Mr Mambanje said their requests equated to asking the court to “move forward in reverse mode.”

The court said by not opposing their placement on remand on the initial appearance the two were consenting to the State’s application which they now want reviewed.

The magistrate said the application was made after “horses had bolted the stable”.

Sikhala and Sithole are expected back in court on November 15 for trial.
