Businessman Nguwaya not under police probe

There are no current criminal investigations or any pending dockets against Drax Consult SAGL country representative and businessman Mr Delish Nguwaya  over the supply of medicines and medical sundries to the National Pharmaceutical Company (Natpharm).

According to police, Mr Nguwaya, who is also the Geo Pomona Waste Management chair, was cleared by the courts in relation to the Drax Consult Sagl and Natpharm contract.

Mr Nguwaya was arrested in June 2020 and appeared before the courts charged with fraud. However, these allegations have since been dismissed by the courts.

In a statement national police spokesperson Assistant Commissioner Paul Nyathi confirmed the developments.

“The Zimbabwe Republic Police has taken note of the media and public inquiries on the arrest of Delish Nguwaya of Drax Consult Sagl and wishes to set the record straight on the matter.

“The police conducted thorough investigations and duly submitted the docket to the National Prosecuting Authority of Zimbabwe for consideration.

“While the docket was still at the National Prosecuting Authority of Zimbabwe, the Supreme Court of Zimbabwe made a pronouncement (Judgment number SC 66/23 and Civil Appeal number 173/22) and found that the contract between Natpharm and Drax Consult Sagl was valid. This judgment was subsequently placed before the National Prosecuting Authority of Zimbabwe,” he said.

Asst Comm Nyathi said the NPA had declined to prosecute Mr Nguwaya after the Supreme Court judgment and over the lack of evidence of any criminal inclination in relation to the Natpharm contract.

“The Zimbabwe Republic Police therefore takes note that the National Prosecuting Authority of Zimbabwe has since declined to prosecute Delish Nguwaya on the basis of the following facts: The Supreme Court of Zimbabwe judgment on the validity of the contract between NatPharm and Drax Consult Sagl and the lack of evidence of any criminal inclination on the conduct by Drax Consult Sagl, Dilesh Nquwaya and NatPharm in relation to the contract in                                                     question.

In a letter dated September 26 and addressed to Mr Nguwaya’s lawyers, Rubaya and Chatambudza Legal Practitioners, the National Prosecuting Authority of Zimbabwe confirmed that it was not prosecuting Mr Nguwaya on fraud charges.

“We refer to your previous letters and in particular, your letter dated December 20, 2022. We apologise for the late response.

“This is due to the fact that the matter was receiving serious consideration. Please be advised that prosecution has since been declined and the police have been advised,” read the letter.

Asst Comm Nyathi said the police had also taken note of the Supreme Court of Zimbabwe and National Prosecuting Authority of Zimbabwe decision on the fact that the money that was paid to Drax Consult Sagl by Treasury has been cleared and deemed clean money which should be paid to Drax Consult Sagl for the medicines which were delivered and consumed by medical facilities in the country.

“The Zimbabwe Republic Police reiterates that currently there are no criminal investigations on Delish Nguwaya or any pending docket held by the Police,” he said.
