Widow weeps  in murder trial

A Masvingo widow on Monday brought business at Masvingo High Court to a halt when she wept uncontrollably while giving evidence during the trial of a man accused of killing her husband in February this year.

Ms Lydias Nyamayevhu of Target Kopje suburb in the city wailed as she narrated how her husband Edwell Mudisi succumbed to injuries he suffered after he was struck with a pair of catapults by a neighbour, who accused him of peeping through his window. The trial of Venacio Maovere, who is facing murder with actual intent charges for allegedly killing Mudisi, kicked off before High Judge Justice Garainesu Mawadze in the morning.

Ms Nyamayevhu, who revealed to the court that she has never attended school in her life, started crying after failing to contend with being asked by Justice Mawadze to describe the accused’s home. Maovere, through his defence counsel Mr Collen Maboke of Ruvengo and Maboke Company, requested to make an application for discharge.

They argued that the key State witness was failing to provide the court with evidence linking his client to Mudisi’s death. Mr Maboke told the court that before his death Mudisi did not identify the person who attacked him hence there were no reasonable grounds to assume it was Maovere who caused his death.

Justice Mawadze is still to rule on the application for discharge by Maovere. Prosecutor Ms Sophia Bhusvumani alleged that on 18 February this year at around 10pm, Maovere was sleeping with his family in Target Kopje suburb when Mudisi peeped through his window.

The State alleges that while he was peeping, Maovere took a pair of catapults and allegedly struck Mudisi below the eye. Maovere allegedly proceeded to assault Mudisi with a plank all over the body until he fell down. Mudisi allegedly pulled himself up and fled into his house. Mudisi died the same day.
