THE State will summon Spirit Embassy Ministries leader Prophet Uebert Angel Mudzanire’s lawyer to testify in the ongoing trial of a Harare man accused of helping the Church leader in defrauding businessman Mr Ndabazinengi Shava of his Bentley.

Law officer Mr Editor Mavuto said there was need for Prophet Angel’s lawyer Mr Wellington Pasipanodya of Manase and Manase Legal Practitioners, to confirm in court that he was the one who prepared the affidavit filed at the High Court in which the man of the cloth cited that he did not know the complainant Mr Shava since he had dealt with the accused Andersen Tagara.

The State wishes to tender the plea as evidence in the pending fraud case at the Harare magistrates’ court.

Mr Mavuto had made an application to tender Prophet Angel’s plea but Tagara through his lawyer Mr Itai Ndudzo, objected to the production of the plea arguing that it was based on hearsay.

He said it was not a public document, which could be tendered as exhibit as required by the law adding that the plea germinated from the dispute between Prophet Angel and Shava at the High Court in which his client was not involved.

“Your worship the tendering of the plea is prejudicial to my client unless the authors of the plea are called to testify before the court. It is through my respectful submissions that the documents patently constitute hearsay evidence. According to the Law no hearsay evidence shall be admissible in any case hence the plea in question does not qualify,“ he said.

Regional magistrate Mr Noel Mupeiwa, remanded the matter to tomorrow for continuation of trial when Prophet Angel’s lawyer is expected to testify.
