Tout fined for assault over kombi loading fee

A city tout was last Tuesday fined $50 or 10 days in prison after he was convicted of assaulting a commuter omnibus driver over R5.

Nyasha Munhenga (20), appeared before Mbare magistrate Ms Gladys Moyo, charged with assault.

In passing sentence, Ms Moyo considered that Munhenga was a first time offender and that he had not wasted the court’s time by pleading guilty to the charge.

“You have shown contrition by pleading guilty to the charges, but you have to make sure that you do not commit a similar offence in the next five years,” she said.

“You have to be warned that if you commit a similar offence you will be incarcerated without the option of a fine.”

Facts were that on April 23 this year, Munhenga was touting for passengers at Kuwadzana 7 turn-off in Harare while loading Donemore Mukomeka’s commuter omnibus.

Mukomeka then paid Munhenga R5 for his services, but he demanded a dollar instead.

The two started arguing and Munhenga ended up assaulting Mukomeka using fists.

Mukomeka sustained some injuries and reported the matter to police.
