Silundika house wrangle to be to settled out of court

Mr Johnson Ncube was involved in a battle that spilled into the courts for ownership of the Silundika house, number 14 McNeille Road in Bulawayo’s Riverside suburb, with the national hero’s children.
Mr Ncube got married to the late Mrs Martha Silundika on 16 September 2000 under the Marriages Act Chapter 5:11.

Following her death in 2003, he continued living at the Silundika home at number 14 McNeille Road in Bulawayo’s Riverside suburb.
On 2 January, the children evicted him from the house.

However, Bulawayo High Court Judge Justice Lawrence Kamocha granted him a provisional order allowing him to return to the house on 14 January.
Mr Ncube on Wednesday said he had withdrawn his case from court after speaking with Cde Silundika’s eldest son.
“I talked to Paul and we agreed to solve the issue amicably. I have withdrawn my case from the courts. All I want is for the children to buy me a four-roomed house in the western suburbs,” said Mr Ncube.

He said he was saddened by the negative publicity that the case had attracted.
Mr Ncube had a copy of a letter that he wrote to his legal representative, Mr Thamsanqa Khumalo, of T Khumalo and Partners, advising him to drop the case.
“I write with regard to the estate of the late Mrs Martha Silundika and hereby give notice that the disputed settlement of the estate will now be determined between myself and my step-children, the Silundika family.
“This notice supercedes all the legal proceedings, preceding this date, 27 January 2011,” read the letter.

Mr Ncube said Mr Paul Silundika had appointed a member of his family, Mr Peter Msebele, to represent the Silundikas in the negotiations that would start soon.-Chronicle
