MP charged with assault

Chibaya, who is also deputy national chairperson of MDC-T party Youths Forum, was arrested together with his driver last Saturday after he allegedly led MDC-T youths to attack Mr Lovemore Hungwe and patrons who were drinking beer at Mkoba 20 Shopping Centre.

Chibaya who fled the scene together with a group of about 10 MDC-T youths soon after committing the offence allegedly went and met Mr Augustine Mutsuva and tried to persuade him to give a false report to the police that he was the one driving the legislator’s vehicle when the crime was committed.

Chibaya was not asked to plead to both charges and was remanded out of custody to 17 January on US$100 bail.
He was ordered to continue residing at his house number 416/2 MkobaVillage 13 and was also advised not to interfere with State witnesses as part of his bail conditions.

For the State, Mr Bernard Nyoni told the court that on 11 December, the accused, Chibaya was chairing an MDC-T Youths forum meeting at Mkoba Village 18 which ended at around 4:30 pm.
Mr Nyoni said at around 7pm, Chibaya then teamed up with MDC-T youths and drove them in his Isuzu truck, while singing and chanting MDC-T slogans.

The court heard that Chibaya and the youths, who are still at large, then stopped at an off sale bar at Mkoba 20 Shopping Centre before a group of about 10 youths who were in the vehicle went straight to where the complainant, Mr Hungwe, was seated drinking beer with other patrons.

Mr Hungwe, a Warrant Officer Class Two is employed by the Zimbabwe National Army and is based at HQ5 Brigade at Battlefields near Kwekwe.
Mr Nyoni said the youths together with the legislator assaulted Mr Hungwe.

The court heard that other patrons who were also caught in the crossfire managed to escape unhurt.
The court further heard that the complaint managed to identify Chibaya when he allegedly attacked him with an empty beer bottle resulting in him falling into a ditch.

Mr Nyoni said after realising that the complainant was bleeding profusely, Chibaya and the youths drove away in their truck leaving Mr Hungwe lying helplessly in a pool of blood.
It is the State’s case that after committing the crime, Chibaya met one, Mr Augustine Mutusva the owner of Quick Fix garage andtold him that he had committed an offence.

Mr Nyoni said Chibaya allegedly tried to persuade Mr Mutsuva to give the police a false report that he was the one driving the vehicle when the offence was committed.
Police interrogation later revealed that Chibaya was among the youths who assaulted Mr Hungwe resulting in his arrest.
Mr Reginald Chidawanyika of Chitere and Chidawanyika represented Chibaya.-Chronicle
