Chinyama is alleged to have called a Harare businessman Mr Paul Westwood a self-confessed drug addict.

Mr Westwood was testifying in the case in which businessman Temba Mliswa was accused of seizing US$1 million worth of shareholding in Noshio Investments.
Mr Westwood was the key State witness.
The lawyer who was represented by Mr Dumisani Mthombeni of Samukange and Venturas appeared before Mrs Estere Chivasa. Mr Mthombeni told the court that on his last remand he had promised the court that he would apply for refusal of further remand.

Prosecutor Ms Sarah Bosha submitted that she was not yet in possession of the docket but it was on its way from the police station. However, Mr Mthombeni said his client had been remanded several times in the trial court arguing that when a matter is sent to a trial court the presumption is that the State is ready for trial.

He said the State would suffer no prejudice if the matter was brought to court by way of summons.
The magistrate concurred with the defence and refused further remand. The lawyer, it is alleged, told the court that Mr Westwood was a self-confessed drug addict currently on medical rehabilitation.
