An ex-convict is at loggerheads with his wife after their children disclosed her extra marital affair while he was in prison, the Harare Civil Court heard yesterday.

Lovejoy Makumbe claimed his wife, Day Makumbe, was cohabiting with her boyfriend for the 17 months he spent in prison.

Day was seeking a protection order against Lovejoy whom she referred to as her ex-husband.

“I am seeking a protection order against this man because he is in the habit of physically and verbally abusing me accusing me of having extra-marital affairs,” she said.

Day told Harare Civil Court magistrate Mrs Babra Masinire that she was no longer staying with Lovejoy, referring to him as her ex-husband.

“I am currently staying at my parent’s house but he keeps coming there to physically abuse me in front of them,” said Day.

She said Lovejoy was threatening to kill her or break her bones.

“I want him barred from coming to my place of residence because he is disturbing my peace,” Day said.

Lovejoy refuted the allegations and accused Day of having extra marital affairs while he was incarcerated.

“I was in prison for the past 17-months and when I was released, my children told me that their mother was having extra marital affairs,” he said. He said Day was still his wife and not ex-wife as she had alleged.

Mrs Masinire granted the order in Day’s favour which barred Lovejoy from verbally or physically abusing her.
