Demolitions: Judgment reserved

THE High Court has reserved judgment in a case in which Epworth residents are seeking to stop the demolition of their dwellings in the Stoob area. Several people had their houses demolished over the past two weeks by the local authority for building on an undesignated area. Through the Zimbabwe Lawyers for Human Rights, the affected residents sued Epworth Local Board, the ministries of Local Government, Public Works and National Housing and Home Affairs for the alleged arbitrary destruction of their dwellings.
On Tuesday Justice Nicholas Mathonsi heard the urgent chamber application and reserved his ruling.

The Epworth residents argued that the demolitions and evictions from their homes were done without a court order.

They also argued that the demolitions infringed on their constitutional rights and were unlawful because due process was never followed. During the hearing, the local authority, argued its role was only limited to surveying and allocating industrial stands to deserving beneficiaries.
