after the Supreme Court dismissed their application to have their case treated as a civil matter.
The couple, Zhaosheng Wu and Yan Yu, is jointly charged with Dawid Johannes Erasmus, the director of Eras Accounting and Executor Services.

The trial, which was supposed to start last week, was postponed to allow the State to secure the services of a Chinese interpreter.
Yesterday, the trial continued before regional magistrate Mr Never Katiyo with Mrs Lillian Dias, the complainant’s wife being cross-examined.
Mrs Dias maintained under cross-examination that Wu, Yu and Erasmus defrauded her husband, Atur Fernado Pereia Dias of his shares.

The three, through their lawyers, had made a constitutional application to the Supreme Court arguing that the matter was not criminal but civil.
They argued that treating a civil matter as a criminal case violated their constitutional rights.

However, Chief Justice Godfrey Chidyausiku sitting with Justices Wilson Sandura, Vernanda Ziyambi, Paddington Garwe and Misheck Cheda dismissed the application in July.
The Supreme Court ruled that the case was criminal and referred it for trial at the magistrate court.
Allegations are that the couple agreed to buy Monomotapa Garden Furnisher Pvt (Ltd) belonging to Mr Dias and got Erasmus to forge a share certificate purporting he was a director of the company.

They then transferred 1 000 shares into the couple’s company, Shomet Industrial Development.
The shares were valued at US$500 000. The trial continues today.
