Chief Serima, Mr Vengai Rushwaya of Gutu has lost a tractor allocated to him by Government under the farm mechanisation programme after the Sheriff of the High Court in Masvingo attached it when the traditional leader lost an assault case. Mpandawana businessman Mr Naison Bvungo successfully sued Chief Serima for more than US$50 000 at Masvingo High Court after the traditional leader assaulted him in a row over a cage in August last year.

Chief Serima is also said to have pointed a firearm to the businessman.

Masvingo High Court Judge Justice Joseph Mafusire, however, ordered Chief Serima to pay US$6 400 plus interest pegged at five percent per annum after passing a default judgment against Chief Serima.

The Sheriff of the High Court proceeded to attach Chief Serima’s tractor from his Rossal Farm in Chartsworth in Gutu.

The tractor is awaiting auctioning to raise money for damages plus interest awarded to Mr Bvungo.

The Ministry of Agriculture, Mechanisation and Irrigation Development, however, tried to stop the auctioning of the tractor after making some inter-pleader summons against the attached tractor in May this year.

Mr Bvungo, through his lawyer Mr Collen Maboke of Ruvengo Maboke and company proceeded to write to the Sheriff of the High Court in Masvingo advising to proceed with the tractor’s auctioning.

They argued that the Ministry of Agriculture had not sought an order staying execution of the said tractor.

In his lawsuit against Chief Serima, Mr Bvungo claimed damages of US$51 400 after the traditional leader’s wife sold road runner chickens to Mr Bvungo.

The businessman runs a butchery, bottle store and a grocery shop at Mpandawana Growth Point.

Chief Serima’s wife left her cage at Mr Bvungo’s business premises after receiving US$10 payment in advance on the promise that she was going to supply a cock to the businessman.

The pair agreed that the Chief’s wife would collect her cage on delivering the cock.

However, Chief Serima, on August 12 last year, went to Mr Bvungo’s business premises and assaulted Mr Bvungo, accusing the businessman of refusing to release the cage.

Mr Bvungo fled and sought refuge in one of his offices after Chief Serima had been restrained by people at the business complex.

Chief Serima followed Mr Bvungo and pointed a firearm at him but was again restrained by members of the public.

Mr Bvungo filed a report of assault at Gutu Police Station and received treatment at Gutu Mission Hospital where a medical report showed that he had dislocated a joint on his right hand finger.

Mr Bvungo then filed for damages against Chief Serima at Masvingo High Court for US$50 000 damage.

He also demanded payment of US$1 200 to cover salary costs of the person he hired to perform his duties for two months after dislocating his finger.

Mr Bvungo further demanded US$200 to cover his medical costs and also costs of the suit against Chief Serima at Attorney-client scale.

He claimed that his standing as a prominent businessman at Mpandawana was compromised by Chief Serima who humiliated him in-front of his customers, employees and fellow businessman.

The Mpandawana businessman also argued that as a custodian of the country’s traditional values and norms, Chief Serima was supposed to lead by example and refrain from violence.
