Chamisa gives notice to court

Chamisa, who is the Information Communication Technology Minister, yesterday appeared before Harare magistrate Mr Tawengwa Chibanda who deferred the matter to April 7.
His lawyer, Mr Chris Mhike of Atherstone and Cook, gave notice that his client wanted to make an application for referral to the Supreme as “constitutional matters had arisen”.
On his initial appearance Mr Mhike submitted that bringing his client to court two years after the accident took place was politically-motivated.
“It was an inordinate delay on the part of the State in instituting the prosecution for an accident that happened two years ago. It is certainly out of the ordinary.
“Judging by the manner the papers were furnished in the State outline, this is a rushed prosecution,” said Mr Mhike.
Prosecutor Mr Nathaniel Chigoro alleges that Chamisa caused an accident in January 2009 along Sam Nujoma Street due to negligence causing “minor damages” to two vehicles.
It is alleged that on January 16, 2009 at about 1:10pm all three parties in question were travelling north along Sam Nujoma Street in the same lane.
The first and second parties reduced speed at the intersection of Natal Road and Sam Nujoma Street as there was a vehicle ahead turning right.
Chamisa, it is alleged, hit the first party from the rear and due to the impact that vehicle hit the third party.
Meanwhile, MDC-T’s Zhombe legislator, Rodger Tazviona, and six other men charged with threatening to harm Chief Samambwa, were yesterday granted US$100 bail each by the High Court.
Tazviona was arrested on February 14 along with Lazarus Kaswera, Crispen Tazvivinga, Idea Makota, Simbarashe Mtengo, Taurai Chinembiri and Albert Mudzingwa for allegedly making violent threats to Chief Samambwa.
They are being represented by lawyer, Mr Dumisani Kufaruwenga of Dzimba, Jaravaza and Associates.
Mr Beaven Murevanhema from the Attorney-General’s Office appeared for the State.
Justice Samuel Kudya said a Kwekwe magistrate who denied the six bail had erred.
It is alleged the six accused the chief of inciting Zanu-PF supporters to forcibly grab MDC-T T-shirts and party cards before threatening to kill him and to destroy his homestead “within seconds”.
After threatening the chief, the gang gave him up to seven days to return the T-shirts and cards, it is alleged.
