Baloyi bail appeal hearing postponed for fourth time

The High Court has, for the fourth time, postponed hearing of a bail appeal by former police assistant commissioner Gidion Baloyi, who was last month jailed for nine months for bringing the name of the force into disrepute. Baloyi, a staff officer at Police General Headquarters, was found guilty of corruptly facilitating the release of a fraud suspect through an instruction to a junior officer.

Yesterday morning, Justice Garainesu Mawadze wanted to deal with the matter but Baloyi’s counsel Advocate Thabani Mpofu was tied up in another case at the Supreme Court.

When Adv Mpofu finished business at the Supreme Court, Justice Mawadze was committed to other issues prompting the parties to agree on the fourth postponement to today (Wednesday).

Last Tuesday the same case was before Justice Esther Muremba who postponed the case after State counsel Mrs Sharon Fero requested a transcription of the magistrates’ court record as the handwritten one was illegible.

Last Friday Baloyi’s legal practitioner Mr Misheck Hogwe of Hogwe Dzimirai and Partners, sought a postponement to allow him to brief Adv Mpofu to argue the matter and file a supplementary affidavit.

Advocates are engaged through referral by an attorney in cases where the law firm or the client needs assistance.
Clients do not have direct access to advocates, but they instruct them through attorneys, who send briefs to the advocates’ chambers.
Baloyi says he is being persecuted for unearthing corruption by senior officers.

Magistrate Mr Elijah Makomo jailed Baloyi for trying to protect Nevermind Kufakunesu accused of swindling a local businessman Mr Batsirayi Mupindu of chickens worth US$21 000.
